The petitioners have preferred the present writ petition challenging the order dated 29.11.2024 passed by the Respondent- State Consumer Redressal Commission, Lucknow in Appeal No. 681 of 2022 (Balaji Agro Seeds Vs. Oriental Insurance Company & Another). 2. It is argued that though the petitioner is entitled for the interest @ 12.5% but wholly illegally only 8% interest has been awarded by the aforesaid order. 3. It is argued by Shri Anubhav Sinha, learned counsel appearing on behalf of Respondent Nos. 2 & 3 that nothing has been stated in the entire writ petition nor any argument has been raised that under which provisions of law, the petitioners are claiming the interest @ 12.5% and prays that the present writ petition is liable to be dismissed. 4. At this point of time a prayer has been made by the counsel for the petitioner to dismiss the present writ petition as not pressed. 5. Accordingly, the writ petition is dismissed as not pressed. 6. It is made clear that no liberty whatsoever has been granted to the petitioner to file a fresh petition for the same cause of action.
