By way of the persent petition, the applicant has prayed for the following reliefs :- “(A) YOUR LORDSHIPS may be pleased to admit this application. (B) YOUR LORDSHIPS may be pleased to quashing and setting aside order dated 25.09.2025 passed below Ex-09 in connection with Criminal Appeal No.80 of 2025 pending before the Ld. 4th Addl. District Judge Surat at Bardoli. (C) YOUR LORDSHIPS may be pleased to relese the applicant in connection with Criminal Appeal No.80 of 2025 pending before the Ld. 4th Addl. District Judge Surat at Bardoli in the interest of justice; R/CR.MA/20817/2025 ORDER DATED: 10/10/2025 (D) YOUR LORDSHIPS may be pleased to passed interim order and be pleased to relese the applicant in connection with Criminal Appeal No.80 of 2025 pending before the Ld. 4th Addl. District Judge Surat at Bardoli till the final disposal of this petition, in the interest of justice;” 2. On 8.10.2025, this Court has passed the following order:- “Learned advocate Mr. Soni, under instructions, states that the applicant is ready and willing to deposit a sum of Rs.6,72,600/- being 30% of the cheque amount with the learned Trial Court as directed by learned 4th Additional District Judge, Surat at Bardoli vide order dated 21.7.2025 passed below Exh.4 in Criminal Appeal No.80 of 2025 whereby the applicant was directed to deposit 30% of the cheque amount within a period of 60 days which the applicant could not deposit within the stipulated time provided by the said order. 2. Learned advocate Mr. Soni, under instructions, states that the applicant shall deposit the aforesaid amount latest by tomorrow i.e. 9.10.2025 and hence, the learned Trial Court may be directed to accept the same. 3. In view of that, in case, if the applicant deposits the aforesaid amount of Rs.6,72,600/- with R/CR.MA/20817/2025 ORDER DATED: 10/10/2025 the learned Trial Court latest by tomorrow i.e. 9.10.2025, the learned Trial Court is directed to accept the same. List the matter on 10.10.2025. Direct service is permitted today. “ 3. Today, it is submitted by learned advocate for the applicant that the said amount has been deposited by the applicant with the learned Trial Court. In view of the fact that the order dated 21.7.2025 passed below Exh.4 in Criminal Appeal No.80 of 2025 by learned 4th Additional District Judge, Surat at Bardoli is already complied with, nothing remains in the matter. Hence, the present application stands disposed of. The applicant is hereby directed to be released from judicial custody forthwith, if not required in any other case.
