MEHRAJ-UD-DIN MALIK …Appellant(s)/Petitioner(s) Through: Mr. Basharat Ahmad Wani, Vs.
UNION TERRITORY OF J AND K AND ORS
...Respondent(s) Through: Ms. Nadiya Abdullah, Advocate
CORAM:
HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE.
ORDER 23.07.2025
1. The only grievance which has been projected in the instant petition is that the petitioner has already filed a detailed representation before Tehsildar Baramulla for carrying out demarcation of the land in question, which till date has not been done inspite of the fact that the requisite fee has been paid. Feeling aggrieved of inaction on the part of the concerned Tehsildar, the instant writ petition has been preferred.
2. The learned counsel for the petitioner fairly submits that the petitioner would feel satisfied if a direction is issued to concerned Tehsildar to carry out the demarcation of the land in question within a reasonable period after affording an opportunity of being heard to all stakeholders including the petitioner.
3. Since innocuous prayer has been made by the learned counsel for the petitioner, this Court deems it proper to dispose of the instant writ petition at the very threshold, by directing the concerned Tehsildar i.e respondent No. 6 to decide the representation alleged to have been filed by the petitioner strictly under rules and as per law, after providing an opportunity of being heard to all the stakeholders including the petitioner.
4. With the consent of the learned counsel for the parties, the instant writ petition is taken up for final disposal at this
stage and is accordingly disposed of with a direction to the respondent No. 6 to accord
consideration to the representation alleged to have been filed by the petitioner, within a period of six weeks from the date of receipt of copy of this order along with copy of writ petition and the annexures appended thereto, strictly in conformity with the rules and as per law. The order of consideration which is likely to be passed by the said respondent be provided to the petitioner through registered post.
5. It is made clear that in case the decision which is likely to be taken on the representation of the petitioner, goes against the petitioner, he shall be at liberty to seek appropriate remedy under law.
6. Writ petition disposed of along with connected CM(s) in the manner indicated above.
