Mr. Manoj Kumar, learned counsel for the applicant. 2. Mr. Siddharth Bisht, learned A.G.A. and Mr. Himanshu Sain, learned Brief Holder for the State. 3. Present applicant- Bablu Mehta is in judicial custody in relation to FIR dated 14.02.2025, registered as FIR No. 04 of 2024 at P.S. Pati, District Champawat wherein the present applicant has b een implicated for the offence punishable under Section 302 IPC. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and the sole eye witness during cross- examination has not supported the case of the prosecution. He further submits that in fact in respect of the said incident the applicant himself informed the father of the deceased. He further submits that the weapon used for commission of crime, which was shown to be recovered from the present applicant, does not belong to the applicant. 5. On other side, Mr. Siddharth Bisht, learned A.G.A. submits that it is wrong to say that the sole eye witness does not support the prosecution case, and, in fact, in examination-in-chief he fully support the prosecution case. He further submits that on pointing out of the present applicant the knife which was used for commission of crime was recovered. He further submits that there was also a strong motive against the applicant. 2025:UHC:1997 6. After hearing the arguments of the learned counsel for the parties, I do not find any merit in the present bail application. 7. Accordingly, the bail application is rejected.
