A prayer for bail has been made on behalf of the petitioner in connection with Naubatpur P.S. Case No.300 of 2024 registered for the offence under sections 302, 379, 147, 148, 149, 342, 341, 323, 427, 504 and 307 of the Indian Penal Code. 3. As per the First Information Report, the informant states that his son along with his friend went out and did not return. One Pappu informed the informant that his son and his friend were brutally assaulted by villagers on suspicion of being

The informant reached the place of occurrence and took them to the hospital, where the informant’s son Sudhir died during course of treatment. 4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. There was some scuffle with the shop owner regarding purchasing of mouth-freshner (Shikhar). Upon alarm being raised by the shopkeeper Mukesh Pandit, along with his mother (petitioner) that the deceased and his friend were thieves, 10-11 unknown accused persons arrived there, variously armed and brutally assaulted the informant’s son by means of lathi, danda, iron rod etc. However, a number of co-accused persons have been enlarged on bail vide orders dated 10.01.2025, 17.01.2025 passed in Cr. Mis. No. 72486 of 2024 and Cr. Misc. No. 83597 of 2024 respectively. The petitioner is in custody since 31.05.2024 and undertakes to co-operate in investigation/trial. 5. The application for bail is opposed by learned APP for the State. 6.Taking into consideration the fact that there is no specific allegation of assault on the petitioner who is a lady having no criminal antecedent and she is in custody since 31.05.2024, the petitioner is directed to be enlarged on bail in
