JUSTICE R DEVDAS ORAL ORDER The petitioners are students of RS-3 MBBS course seeking for a direction to the respondent-university for re- scheduling the supplementary examinations after giving sufficient time from the date of commencement of the results of the regular examinations i.e., 28.07.2025 and to consider the representation given by the petitioners on 14.07.2025. - 3 - HC-KAR NC: 2025:KHC:32256 WP No. 22151 of 2025 2. This Court by order dated 24.07.2025 stayed the impugned notification dated 29.05.2025 at Annexure-F till the next date of hearing. On the previous occasion, this Court heard the learned Counsel for the petitioners, the learned Counsel for the respondent-university and the learned Counsel for the intervening/impleading applicants, in I.A.No.1/2025. However, subsequently the university has filed an application in I.A.No.3/2025 to modify the interim order dated 24.07.2025 and permit the university to conduct the supplementary examinations of UG Medical students of 1st, 2nd and 3rd Professional Part I and Part II of RS-3 scheme, along with MBBS Phase II (CBME) starting from 14.08.2025 or MBBS Phase I (CBME) starting from 24.09.2025. 3. Learned Counsel for the petitioners submits on instructions that if the respondent-university has sought leave of this Court to commence the examination of the petitioners from 24.09.2025, it is acceptable for the petitioners. - 4 - HC-KAR NC: 2025:KHC:32256 WP No. 22151 of 2025 4. Learned Counsel for the impleading applicants would seek to raise a contention that if the university holds the examinations commencing from 24.09.2025, the impleading applicants will loose out on appearing in the NEET examination of the next year. 5. In the considered opinion of this Court having regard to the grievances vented out by the petitioners and the reaction on the part of the respondent-university in coming before this Court and clearly stating that it may be permitted to hold the examinations commencing from 14.08.2025 or 24.09.2025 and the fact that 14.08.2025 has already elapsed, it would not be unreasonable to accept the submissions made on behalf of the respondent- university. 6. In that view the matter, the writ petition stands disposed of granting liberty to the respondent-university to conduct the examinations of UG Medical students of 1st - 5 - HC-KAR NC: 2025:KHC:32256 WP No. 22151 of 2025 2nd and 3rd Professional Part I and Part II of RS-3 scheme, commencing from 24.09.2025.
