CRM-M-39972-2025 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 123 CRM-M-39972-2025 Decided on:28.07.2025 Ishwar and another ......Petitioners Versus State of Haryana and others ......Respondents CORAM: HON'BLE MR. JUSTICE SANJAY VASHISTH Present: Ms. Ritu Pathak, Legal Aid Counsel for the petitioners. Mr. Kanwar Sanjiv Kumar, AAG, Haryana. (appears on advance notice) **** SANJAY VASHISTH , J. 1. Present petition has been filed under Section 528 of BNSS, 2023, seeking issuance of directions to official respondents No. 3 and 4 to take appropriate legal action on the complaint dated 13.11.2024 given by the petitioner. 2. Upon consideration of the material on record and the submissions made, this Court finds that the remedy sought by the petitioner is neither maintainable under Section 528 of BNSS nor appropriate at this stage. The Section does not empower this Court to direct the respondents to examine representations or take specific legal action in the manner sought. Furthermore, the nature of the grievance relates primarily to a financial dispute, which is ordinarily resolved through appropriate civil or statutory forums designated for such matters. RASHMI 2025.07.29 19:45 I attest to the accuracy and integrity of this document CRM-M-39972-2025 3. In view of the above, the present petition is not maintainable and is accordingly dismissed. 4. However, it will be open for the petitioner to avail alternative remedy available under law, including approaching the competent civil forum or any other appropriate authority, for resolution of the financial dispute.
