JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.2 under Section 483 Bharathiya Nagarik Suraksha Sanhitha, 2023, praying to grant bail in Crime No.206/2025 of Pavagada Police Station, registered for offences punishable under Section 108, 85, 351(2) 54, r/w. 3(5) Bharathiya Nagarik Suraksha Sanhitha, 2023. 2. Heard the learned counsel for petitioner and learned High Court Government Pleader for respondent/State. 3. The learned counsel for petitioner submits that the petitioner is an employee in a University of Agricultural Science, Bangalore, and she was working in Mandya since 15 to 20 years and in her Aadhar Card her address is - 3 - HC-KAR NC: 2025:KHC:49513 CRL.P No. 15059 of 2025 mentioned as Mandya. The petitioner is not residing with deceased and accused No.1. Deceased and accused No.1 were residing in Pavagada. The petitioner was not involved in the day-to-day affairs of the family of the deceased and her husband/accused No.1. The petitioner has been arrested on 21.09.2025 and she is in judicial custody and in the remand application, there is a mention that she is not required for further custodial interrogation. The accused No.4 has been granted bail by the Sessions Court. The petitioner is ready to abide by any conditions to be imposed by this Court. With this, he prays to allow the petition. 4. Per contra, learned HCGP would contend that the deceased is fed up with the harassment given by her husband, mother-in-law and grandmother of her husband, committed suicide and also killed her two minor children. The investigation is in progress. If the petitioner is granted bail, he will hamper the investigation and tamper the - 4 - HC-KAR NC: 2025:KHC:49513 CRL.P No. 15059 of 2025 prosecution witnesses. With this, she prayed to reject the petition. 5. Having heard the learned counsel for the petitioner and learned HCGP for respondent-State, the Court has perused the FIR, complaint, remand application and other materials placed on record. 6. As per the averments of the complaint, the marriage of deceased with accused No.1 had taken place 6 years ago and they are having a son aged four years and a daughter aged one and a half years. The deceased and her husband were residing in Pavagada. It is alleged that the petitioner being mother-in-law and accused No.1, husband of the deceased used to harass and ill-treat the deceased. The deceased fed up with the same has not only committed suicide but also killed her two minor children. 7. The petitioner is a woman and employee of University of Agricultural Sciences, Bangalore. As per copy - 5 - HC-KAR NC: 2025:KHC:49513 CRL.P No. 15059 of 2025 of identity card, she is working in Mandya. Copy of the Aadhar Card produced indicates her address as 'Mandya'. The offences alleged against the petitioner is not punishable either with death or imprisonment for life. Whether the petitioner has abated the deceased to commit suicide is a matter of investigation and trial. The petitioner is a woman and she has undertaken to co-operate with the police in further investigation and abide by any conditions to be imposed by this Court. There are no criminal antecedents of the petitioner. 8. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. 9. In the result, the following ORDER i) The petition is allowed. ii) The petitioner is granted bail in Crime No. 206/2025 of Pavagada Police Station, subject to following conditions: - 6 - HC-KAR NC: 2025:KHC:49513 CRL.P No. 15059 of 2025 a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court. b) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioner shall attend the Trial Court on all dates of hearing, unless exempted and co-operate for speedy disposal of the case.
