The F.I.R. was lodged by the police party against the applicant and six other accused. After arresting the applicant police has shown false recovery of four white metal ornaments, one mobile phone and five hundred rupees from the possession of applicant, there is no independent witness of such recovery and the same is implanted upon the applicant with malicious intention. Two co-accused, namely, Gulshan Yadav and Raj Yadav who were also arrested along with the applicant have already been enlarged on bail and as the case of applicant is not on the worse footing than that of the aforesaid co- accused, therefore, applicant may also be enlarged on bail. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed before the Court.
