2. This Civil Miscellaneous petition has been filed seeking to condone the delay of 1258 days in filing the Civil Miscellaneous Appeal.
3. Heard the learned counsel for the petitioner and Mrs.M.Malar,
learned counsel for respondents 1 to 3 and also carefully perused the records.
4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 1258 days is condoned, subject to the condition that the petitioner deposit a sum of Rs.2,500/- to the credit of the President, Tamil Nadu Advocate's Clerk Association, Madras High Court, Chennai (Indian Bank, High Court Branch, A/c No.484026006, IFSC Code:IDIB000M157), within a period of one week from today.
5. Registry is directed to number the main Civil miscellaneous appeal, if it is otherwise in order and list the same for admission.
