JUSTICE ANU SIVARAMAN) This Contempt of Court case is filed alleging non- compliance of the order dated 05.12.2023 in W.P.No.19832/2022. The writ petition was filed challenging the communication dated 12.04.2022 in No.HSG- 1/61/HHS/2021-22 issued by respondent No.2. The writ - 3 petition was dismissed holding that the petitioner's conduct disentitled him to relief, whereby upholding the Registrar of Co-operative Societies order dated 12.04.2022 for allotment of Site No.219 in the name of Shri. Praveen Kumar B.N, the complainant. 2. We have heard Shri. Vinod Prasad, learned counsel for the complainant and Shri. Devi Prasad Shetty, learned counsel for accused No. 1 and 2. 3. The complainant submits that though the writ petition filed against the order of the Registrar of Co- operative Societies was dismissed by this Court, the allotment in favour of the complainant has still not been effected. 4. Having considered the contentions advanced, we are of the opinion that since the writ petition filed by the Society stands dismissed, it is for the complainant to work out his remedies for allotment of the Site if the same has not been done in compliance with the order passed by the competent officer under the Co-operative Societies Act. - 4 Since the writ petition stands dismissed there is no question of non-compliance with the directions of this Court and a complaint alleging Contempt of Court would not be maintainable in the facts and circumstances of the case. 5. The Contempt of Court Case is closed without prejudice to the right of the complainant to avail the appropriate remedies as available to him under law and to seek allotment in terms of applicable orders.
