The petitioner apprehends his arrest in a complaint case registered for the offence punishable under Sections 323, 313, 354, 429 and 34 of the Indian Penal Code. 3. As per prosecution case, on the alleged date and time of occurrence, a dispute arose between the parties after the cattle (pigs and goats) of the complainant died and the complainant/Opposite Party No. 2 doubted that it was caused due to poison sprinkled over the pulse corps. It is alleged that on 29.05.2023 at about 2PM, all the accused persons named in the complaint petition, including this petitioner, armed with lathi, came to house of the complainant/Opposite Party No. 2 and Patna High Court CR. MISC. No.82471 of 2024(3) dt.27-01-2025 2/3 thereafter abused her and pulled her by her hair. It is further alleged that they also tore her clothes and assaulted her as a result of which miscarriage was caused. 4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. From perusal of the complaint petition it is apparent that due to petty dispute over cattle, a simple maar-peet took place between the parties. There is case and counter-case between the parties and Khaira P.S. Case No. 340 of 2023 has been lodged by grandmother of the petitioner against the complainant and others. There are general and omnibus allegations and there is no specific accusation of overt act against this petitioner. Petitioner claims clean antecedents. 5. On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the complainant/Opposite Party No. 2 have vehemently opposed the prayer for grant of anticipatory bail to the petitioner. 6. Considering the aforesaid facts and circumstances, nature of accusation, case and counter-case between the parties and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed. 7. Accordingly, in the event of arrest/surrender within Patna High Court CR. MISC. No.82471 of 2024(3) dt.27-01-2025 3/3 a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Jamui in connection with Complaint Case No. 736(C) of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. shashank/- (Prabhat Kumar Singh, J) U T
