NARASINGH Order No. ORDER 17.11.2025 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.14 of 2023 pending in the Court of learned A.D.J. Spl. Judge, POCSO, Jagatsinghpur, arising out of Jagatsinghpur P.S. Case No.136 of 2023 for alleged commission of offences punishable under Sections 376(2)(n), 294, 506, 34 of IPC, 1860 and Section- 6 of POCSO and Section- 66E and 67 of IT Act, 2008. 3. It is submitted by the learned counsel that admittedly the Petitioner was before this Court in ABLAPL No.13692 of 2023 and vide order dated 01.12.2023 this Court rejected the prayer of pre- arrest bail referring to the 164 statement of the victim and the medical opinion. 4. It is further submitted by the learned counsel that since the charge sheet has already been filed in the meanwhile, the Petitioner may be protected by pre-arrest bail. 5. Learned counsel for the State opposes the prayer for pre-arrest bail. 6 Taking into account the nature of allegations since there is no change in circumstances rather filing of the charge sheet, fortifies the allegations against the Petitioner, this Court is not inclined to entertain the application for pre-arrest bail. However, in the event the Petitioner surrenders before the learned Court in seisin in the aforesaid case and moves an application for his release on bail, the same shall be considered on its own merit. 7.
