1. Quashing of Communication No.ADMCOA (PR)/3/2022-07:169840 dated 14.07.2022, issued by respondent-Board, is sought for in this writ petition. Petitioner also seeks a direction upon respondents to grant him 2nd in-situ promotion including arrears from the date he is entitled thereto.
2. The short grievance of the petitioner is that he, despite being eligible and entitled to, the 2nd in-situ promotion as available in terms of sub clause (g) of clause 5 mentioned in Order No.252-B of 2001 dated 26.04.2001, has not been given to him.

Learned counsel for the petitioner submits that petitioner would feel satisfied if this writ petition is disposed of by directing the respondents to consider him for grant of 2nd in-situ promotion in terms of order referred above.
4. Mr. M. I. Dar, learned counsel for the respondent-Board submits that petitioner has already been granted 1st in-situ promotion and now it is to be seen as to whether the order supra would apply for granting him
2nd in-situ promotion or not. He further submits that respondents would examine the case of petitioner for 2nd in-situ promotion and find out whether he is entitled to it or not.

Having regard to the submissions made by learned counsel for the parties, the present writ petition is disposed of with a direction to the respondent-Board that the moment the petitioner makes the representation for grant of 2nd in-situ promotion, the respondent-Board shall consider the same strictly in accordance with rules and laws governing the field and pass a speaking order.
6. Let this exercise be completed by the respondents within a period of three months from the date the petitioner makes a representation before them enclosing therewith the instant order as well, besides paper book.

Disposed of as above.
