Goswami, the learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, Page No.# 2/2 namely, Wahedul Karim has prayed for releasing him on bail, after he was arrested in connection with Abhayapuri P.S. Case No. 287/2024. 3. The informant Maznur Rahman alleges in the FIR that his daughter was married to the present petitioner 13 years prior to the lodging of the FIR. The informant has alleged that his daughter could not conceived and that is why she was mentally and physically tortured by the family members of the petitioner. 4. According to the informant, on 16.12.2024, the present petitioner informed him that his daughter was dead. The informant went to the house of the present petitioner. The informant noticed that blood was coming out from the nose and mouth of his daughter. 5. The post-mortem report shows that the deceased woman had committed suicide by hanging. 6. I have considered the submissions made by the learned counsel of both sides in the light of the contents of the case diary. 7. The petitioner has already spent 81 days in judicial custody. 8. This Court is of the opinion that under the given circumstances of the case, the petitioner no longer deserves to be detained in custody. Therefore, his bail application is allowed. 9. It is hereby directed that the petitioner, namely, Wahedul Karim, who was arrested in connection with Abhayapuri P.S. Case No. 287/2024, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (M), Abhayapuri, Bongaigaon.
