THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1908 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking bail, in Crime No.51/2024 of G.Madugula Police Station, Alluri Sitharamaraju District. 2. A case has been registered against the petitioner and others for the offences under Sections 20(b)(ii)(C) r/w 8(c), 25 of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution, in brief, is that, on 15.11.2024 at about 09.00 am, on credible information regarding illegal possession and transportation of ganja, the S.I of Police, G.Madugula Police Station, along with staff and mediators, proceeded to Nurmathi village junction and found one person in possession and illegal transportation of 200 kgs of ganja in Mahindra Commander Jeep bearing registration No.AP 39 GK 4609. The contraband, along with the Jeep and other material, was seized under cover of a mediators report and a case has been registered against the accused. A1 was arrested on 15.11.2024, A2 and A3 were arrested on 27.11.2024 and A4 is absconding. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that investigation is not yet completed and some more witnesses are to be examined and further 2 submitted that huge quantity of contraband was found in possession of the accused and prays to dismiss the Criminal Ppetition. 6. A perusal of the material available on record goes to show that this is the successive bail application and the earlier bail application was dismissed on 02.01.2025 on the ground that investigation is not yet completed and A4 is to be arrested. The petitioner was arrested on 27.11.2024. There are no changed circumstances from the date of dismissal of the earlier bail application to this bail application. As stated by the learned Assistant Public Prosecutor, the investigation is at nascent stage. Hence, this Court is not inclined to grant bail to the petitioner at this stage. 7.
