Heard Mr. Mukesh Chandra Gupta, learned counsel for the petitioner and perused the record. 2. The instant petition has been filed seeking following relief: "(1) Issue, a writ or direction in the nature of cerceorari Quashing the Impugned Order dated 01.07.2025 passed by the Additional District Magistrate Agra in Case No. 4613/2022 Computerized Case No. D202201010004613 (Inder Singh and others Versus Bhupendra Kumar Sharma) under section 21(2) the Uttar Pradesh Regulation of Urban Premises Tenancy Act 2021. (2) Issue, a writ or direction in the nature of Mandamus directing to the respondent no. 3 not to disposed to the petitioner from the rented premises situated at Property No. 31/285 Collectrate Sadar Bhatti Road, Police Station Mantola District Agra situated at Ground floor 25X25 area 598 Sq. Fit, till disposal of Suit No. 227 of 2022 (Bhoopendra Kumar Versus Inder Singh) pending before the Civil Judge (Junior Division) Agra." 3. The order passed by the Rent Authority under Section 21 (2) is appealable before the Rent Tribunal under Section 35 of the U.P. Act No.16 of 1921, as such the instant petition is not maintainable. 4. In view of the aforementioned facts and circumstances of the case, the instant writ petition is dismissed on the ground of alternative remedy with liberty to petitioner to file appeal before appellate tribunal against the order dated 01.07.2025 passed by Rent Authority.
