Prayer in the petition is to issue a writ in the nature of mandamus, directing respondents No.1 to 4 to register FIR against the accused persons, to provide immediate police protection to the petitioner and his family as there was imminent danger to their lives due to extortion and threats extended, further to transfer investigation to Central Bureau of Investigation or Special Investigation Team.
2. Notice of motion was issued on 16.10.2025.

As per reply filed by the State of Punjab, on complaint of the petitioner, FIR No.257 dated 13.10.2025 under Sections 308(4), 351(3) BNS and Section 25 of the Arms Act, 1959 stands registered in Police Station, Phase-I, District SAS Nagar. Further, assessment of threat perception has also been done by the competent authority after joining the petitioner. It is submitted that petitioner was not found to have received any threats from any unlawful organization or from respondent No.6-Harinder Singh alias Rinda and other unknown gangsters.

Learned counsel for the petitioner submits that petitioner was still fearful for his life and liberty as the main accused had criminal antecedents and the police had added Section 238 BNS in the FIR. Further, HARPREET SINGH CHAUHAN 2026.07.23 21:37 I agree to specified portions of this document
3 CRWP-11251-2025 (O&M) on 01.06.2026, petitioner’s residence was surrounded by some unknown armed individuals in a Z-Black luxury car without registration number with the motive to launch lethal attack. A formal complaint in this regard was filed but no action was taken.

There is nothing on record at this stage to suggest that investigation is faulty, unfair or defective. As such, no ground to transfer investigation to CBI or Special Investigation Team is made out. FIR already stands registered on complaint of petitioner. The official respondents are, however, directed to consider representation dated 01.06.2026 filed by the petitioner within a period of one month. In case, it is found that there is a genuine threat to the life and liberty of the petitioner, necessary steps warranted under law be taken at the earliest, so as to ensure that no harm is caused to the petitioner.

The petition accordingly stands disposed of.
