ORAL ORDER
The petitioner seeks direction to the respondent, M/s. Bandhan Bank Ltd., to defreeze his account in No. 20200080194530 considering his representation dated 26.06.2025. Sri Monish C P, the
learned counsel for the petitioner, argues in support of the petition relying upon the different annexures appended to the petition and contending that there was a direction by the Gujarat Police in terms of Annexure-D at the instance of Mrs. Jayaben Vadher [a resident of the State of Gujarat] to transfer Rs. 95,000/- from his account but this account continues to be frozen. The learned counsel relies upon Annexure-C to contend that as of the date of the request for transfer, there was a balance of Rs. 7,66,238.67/-.
On the urgency for orders of this Court, Sri Monish C P submits that the petitioner's mother has died on 25.10.2025 and the petitioner needs

immediate funds. Sri Mahendra B.S., the learned counsel for the respondent, does not dispute the authenticity of the communication addressed by the Gujarat Police requesting for transfer of Rs.95,000/- from the petitioner's account to Mrs. Jayaben Vadher and the instructions by such police to defreeze the petitioner's account.
This Court must observe that if the reason for freezing of the petitioner's account was a claim for sum of Rs.95,000/- and if such amount is transferred upon receipt of communication, there should be no hindrance in law for allowing the petition directing the respondent to defreeze the petitioner's account but without prejudice to the petitioner to pursue remedies that may be available in law insofar as the amount that is already transferred. Hence the following:

ORDER
The petition therefore stands
disposed of directing the respondent to defreeze the petitioner's account in No. 200200080194530 subject to ensuring that a sum of Rs.95,000/- is transferred as required by the undisputed communication from Gujarat Police.
