For Petitioner : Mr.M.Manimaran For R1 : Mr.R.Ganesh Kumar Counsel for Government of Tamil Nadu (Criminal Side) 1/6 https://www.mhc.tn.gov.in/judis W.P.(Crl).No.1675 of 2025 O R D E R This Writ Petition has been filed for a direction, directing the 1st respondent not to issue any Non-Traceable Certificate to the 2nd respondent on his complaint in respect of the original Title Deed for the property comprised in Survey No.66/1 measuring an extent of 0.31.0 ares and in Survey No.66/1A, measuring an extent of 0.29.0 ares, situated at Ulundurpet Taluk, Kallakurishi District based on the petitioner’s representation dated 24.11.2025. 2. Heard the learned counsel appearing on either side and perused the materials available on record. 3. The 2nd respondent is the father of the petitioner herein. The 2nd respondent owned the subject property and subsequently, executed Settlement Deed in favour of his second daughter namely the sister of the petitioner herein. Since she was not allotted any share, the petitioner on the strength of the agreement for sale entered between the petitioner and 2nd respondent herein, filed a suit for Specific Performance in O.S.No.173 of 2025 on the file of the Sub-Court, Ulundurpet and it is pending for adjudication. 2/6 https://www.mhc.tn.gov.in/judis W.P.(Crl).No.1675 of 2025 4. In the meanwhile, in order to deal with the subject property, the 2nd respondent lodged a complaint alleging that the original Title Deed is missing. According to the petitioner, it is in her possession and it was also filed in the suit. 5. On perusal of the suit document, it is revealed that the petitioner annexed only copy of the Settlement Deed and the original Title Deed of the property comprised in Survey No.66/1 measuring an extent of 0.31.0 ares and in Survey No.66/1A, measuring an extent of 0.29.0 ares, situated at Ulundurpet Taluk, Kallakurishi District, is missing. 6. In view of the above, the 1st respondent is directed to conduct an enquiry on the representation submitted by the petitioner, dated 24.11.2025, after issuance of notice to the petitioner and 2nd respondent and if the document is available with the petitioner, the 1st respondent is directed to close the complaint.
