SONI SHRIVASTAVA ORAL ORDER 4 12-05-2025 Heard learned counsel for the petitioner and learned APP for the State. Despite repeated notice and valid service thereof, the O.P. No.2 has not appeared in the present proceedings. 2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 504, 509 and 498A of the Indian Penal Code. 3. Petitioner, who is husband of opposite party no2., is said to have ousted the opposite party no.2 from her Patna High Court CR. MISC. No.82927 of 2024(4) dt.12-05-2025 2/3 matrimonial home in association of his family members over the dowry demand. 4. The First Information Report, discloses the allegations of demand of dowry and torture against the informant/O.P. No.2. 5. Learned counsel for the petitioner submits that the allegations made in the F.I.R. are not correct and as a matter of fact there is no question of dowry as an inter-caste marriage was solemnized between the parties in the year 2016, with consent of both the sides and they had been living peacefully for about 8 years. Two female children were also born out of the wedlock and both the children are staying along with the petitioner. As a matter of fact, the informant herself does not want to continue the conjugal rights with the petitioner 6. In such view of the matter, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Munger, in connection with Mahila P.S. Case No.07 of 2024 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482 (2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner Patna High Court CR.
