JUSTICE SUMAN SHYAM ORDER 24.03.2025 None appears for the petitioner when the matter is called up before this Court. Mr. R. Dhar, learned Standing Counsel, PWD is present for the respondent Nos.1 to 4, 6 and 7 and Mr. D. K. Roy, learned counsel is present for the respondent No.5. None has appeared for the respondent Nos.8 and 9. This writ petition was instituted by the petitioner in the year 2019 while he was serving as Additional Chief Engineer, PWD inter-alia seeking a writ of mandamus directing the authorities to consider his case for promotion to the post of Chief Engineer in the PWD. At that time, the age of the petitioner was 59 years. In the meantime, the petitioner has retired from service. Therefore, the question of issuing a direction to promote him to the post of Chief Engineer does not arise at this point of time.
Moreover, the Lawazima Court order dated 10.01.2025 goes to show that despite specific orders, the petitioner’s counsel has failed to take fresh steps for service of notice upon the respondent Nos.8 and 9. In view of the above, this Court is of the view that not only the prayer made in the writ petition has become infructuous but the petitioner is also no longer serious about prosecuting this case before this Court. As such, this writ petition stands closed as infructuous. JUDGE Comparing Assistant
