Prayer in the instant petition filed under Article 226 of Constitution of India read with Section 528 of BNSS, 2023 is for issuance of direction to respondents No.2 to 5 to protect the life and liberty of the petitioner at the hands of respondents No.6 and 7, who want to implicate the petitioner in a false NDPS case. In compliance of order dated 24.07.2025, status report by way of an affidavit of Deepinderpal Singh, PPS, Deputy Superintendent of Police, Sub Division, Lehra, District Sangrur has been filed on behalf of respondents No.1 to 5, is taken on record. It has been alleged in the status report that an application dated 19.07.2025 submitted by the petitioner (Annexure P1) was received in the office of Senior Superintendent of Police, Sangrur, which was marked for inquiry and report to the Deputy Superintendent of Police, Sub Division, KOMAL 2025.08.13 10:02 I attest to the accuracy of this document
CRWP-7966-2025 (O&M) -2- Lehra. During inquiry, notices No.2248/5A/ DSP Lehra dated 01.08.2025, 2271/5A/DSP Lehra dated 04.08.2025, 2297/5A/DSP Lehra dated 05.08.2025 were issued to the petitioner Shammy Singh to join the inquiry but he was not found to be residing at Lehra (at given address). During the inquiry, statements of Balvir Singh Fauji MC and Monu Singh Halwai (respondents No.6 and 7) were recorded, wherein they had stated that now the petitioner had sold his house in Lehra and started living in another city, since they stopped him from selling drugs in their Ward No.15. It has been further alleged that after conducting thorough inquiry and examination of relevant record, it is revealed that total nine cases of NDPS Act, Excise Act and theft are found to be registered against the petitioner. He is a person with criminal antecedents and is involved in drug business. Now, the petitioner had sold his house in Lehra and started living in another city. As Balbir Singh Fauji MC and Monu Halwai (respondents No.6 and 7) used to stop the petitioner from doing drug business.
So, the false allegations have been levelled against them and no action is required to be taken on his application. Detail of 09 criminal cases registered against the petitioner has also been given in the status report out of which he has been convicted in one case under NDPS and remaining cases are pending trial. It has been submitted that no truth has been found in the allegations levelled by the petitioner against respondents No.6 and 7. The petitioner is habitual offender indulging in nefarious activities against whom 09 criminal cases under NDPS Act, Excise Act and theft are found to be registered. The petitioner is involved in drug trafficking and wanted to sell the drugs in the area of respondents No.6 and 7. Therefore, the present petition being devoid of any merits and deserves to be dismissed. KOMAL 2025.08.13 10:02 I attest to the accuracy of this document
