Though the petitioner has no say in the investigation to be conducted by the 3rd respondent in Crime No.28 of 2025, since the petitioner is an accused, the petitioner made several allegations as against the 3rd respondent. On the complaint lodged by the 4th respondent, the 3rd respondent registered FIR in Crime No.28 of 2025 for the offences punishable under Sections 318(4), 351(3) and 61(2) of BNS alleging that the petitioner had cheated the 4th respondent to the tune of Rs.47,30,20,101/-. After registration of FIR, the 3rd respondent detained the petitioner under legal custody and obtained signature in the Memorandum of Understanding (MOU) between the petitioner and 4th respondent. Therefore, the petitioner lodged complaint before the various authorities including the Tamil Nadu State Human Rights Commission, Chennai and it is now pending for enquiry. However, the complaint lodged before the 2nd respondent was enquired by the then Inspector of Police and closed. 4. On perusal of the above said complaint, there are serious allegations made as against the 3rd respondent and that apart, the complaint is pending for enquiry before the Tamil Nadu State Human Rights Commission, Chennai 3/6 https://www.mhc.tn.gov.in/judis W.P.(Crl).No.1688 of 2025 5. In view of the above, the 2nd respondent is directed to conduct a fresh enquiry on the complaint lodged by the petitioner, after issuance of notice to the petitioner and respondents 3 and 4 herein and dispose of the same in accordance with law, within a period of eight weeks from the date of receipt of copy of this order. It is made clear that in respect of Crime No.28 of 2025 registered as against the petitioner, the 3rd respondent is at liberty to proceed with the investigation in accordance with law. 6. With the above direction, the Writ Petition (Criminal) is disposed of. No costs.
