1. The present petition has been filed praying for a writ of mandamus directing the respondents to release the balance payment of Rs.10,16,000/- to the petitioner on basis of the services rendered by him as an Anesthetist.
2. The case of the petitioner is that Chief Medical Officer, Deoria empanelled six doctors of District- Deoria as Anesthetist vide
order dated 30.09.2024 for providing the services during cesarean operations in hospitals affiliated with Maharishi Devraha Baba State Medical College, Deoria. The petitioner, who was also empanelled and rendered services as Anesthetist during the period 14.10.2024 to 01.02.2025, has been paid only part of the honourarium amount and the balance is still due.
3. Having regard to the nature of controversy, we are of the opinion that interest of justice would be served in directing respondent no.5, on whose order empanelment was done, to examine the claim of the petitioner and take decision on the same.
4. Accordingly, the writ petition is disposed of with direction to respondent no.5 to pass a speaking order in respect of claim of the petitioner regarding payment of balance amount of honourarium within a period of four weeks from the date of communication of the instant order alongwith a fresh representation and supporting documents.
