Learned counsel for the petitioners submits that there are material irregularities in the proceedings initiated by respondent No.2-Bank under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter to be referred as ‘ SARFAESI Act’), as well as the E-auction notice. At this juncture, learned counsel for respondent No.2-Bank, upon instructions from Mr. Mohit, Senior Manager, Punjab National Bank, submits that the petition has been rendered infructuous as the auction(s), which were to take place on 13.12.2021 and 15.11.2022 had been put off due to the interim orders of this Court. He also submits that respondent No.2-Bank shall be issuing a fresh notice under Section 13(2) of the SARFAESI Act.
4. In view of the above, the petition stands disposed of as infructuous.
