1. Challenge in the present petition is to the Office Order No.37 dated 06.07.2018 whereby the respondent(s) No.3 has restricted the actual benefit(s) of the petitioner and only granted the notional benefit(s).
2. After arguing at some length, learned counsel for the petitioner submits that the similar controversy has already been decided by this Court in “Pawan Kumar and Ors. vs. State of Haryana and Ors”, CWP No.5752 of 2020 decided on 21.04.2025. She further submits that the petitioner has already served a legal notice dated 01.05.2025 (Annexure P-4) but the respondents have not taken any action thereupon till date. She contends that the petitioner would be satisfied at this stage, in case respondent No.2-Principal Chief Conservator of Forest, Forest Department Haryana, Sector-6, Van Bhawan, Panckhula is directed to consider and decide the legal notice dated 01.05.2025 (Annexure P-4) served by the petitioner, by passing a speaking order in a time bound RAJ KUMAR ARORA 2025.08.01 15:03 I attest to the accuracy and integrity of this document Punjab & Haryana High Court, CHD

4. Dr. (Ms.) Malvika Singh, DAG, Haryana accepts notice on behalf of the respondents and prays for some time to complete instructions and file response, if necessary. She, however, does not have any objection to the above request.
5. Accordingly, the present petition is disposed of with the consent of the parties and without commenting anything on the merits of the case, by directing respondent No.2 to consider and decide the legal notice dated 01.05.2025 (Annexure P-4) in light of the law including the judgment passed by this Court in Pawan Kumar and Ors (supra) by passing a reasoned and speaking order within a period of three months of the receipt of certified copy of this order.
