JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The brother of the detenu – Harish – CTP 00791 is before this Court seeking for the following reliefs: a. Direct the Respondent No.2 to release the petitioner's brother Harish CTP-00791 on general parole for a period of 90 days in order to Cultivate the Agricultural land and to maintain social ties with the family and to save himself from evil effects due to long incarceration. b. Pass any other order(s) which this court may deem fit and proper under the facts and circumstances of the case, in the interest of justice. 2. The detenu had been convicted for the offences punishable under Sections 120-B, 302, 201 r/w 34 of IPC in S.C.No.215/2012 by the 2nd Additional District and Sessions Judge, Hassan and on 10.08.2023, the detenu has been sentenced for life imprisonment. As on 28.10.2025, the detenu has been incarcerated for a period of 8 years 7 months and 22 days. - 3 - HC-KAR NC: 2025:KHC:50018 WP No. 33340 of 2025 3. The learned counsel for the Petitioner submits that the detenu had been granted parole on one earlier occasion. 4. The detenu having made an application for grant of parole on the ground that there is no one else in the family to carry out agricultural work, the said application having been rejected by the respondents on the ground that there was one other case which has been pending against the detenu in C.C.No.212/2015, in that background, the detenu is before this Court seeking for the aforesaid reliefs. 5. The case which has been cited against the detenu is one which had been initiated in the year 2015 even before the detenu was convicted in S.C.No.215/2012 under which detenu is undergoing incarceration. The detenu had been granted court parole on one earlier occasion and there being no allegation, and the conduct of the petitioner being satisfactory in the jail, I am of the considered opinion that the detenu ought - 4 - HC-KAR NC: 2025:KHC:50018 WP No. 33340 of 2025 not to have been denied general parole. As such, I pass the following: ORDER i) The Writ Petition is allowed. ii) Respondent No.2 is directed to release detenu – – Harish – CTP 00791 on parole for a period of 90 days commencing from 11.12.2025, subject to the following conditions. a) The prisoner (CTP 00791) shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take him to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of parole. b) Respondent No.1 shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and - 5 - HC-KAR NC: 2025:KHC:50018 WP No. 33340 of 2025 that he shall not commit any other offence during the period of parole. iii) The Registry is directed to communicate the order to the Prison Authority for its immediate execution.
