Ms. Swati Sharma, Advocate, for respondents No.1 & 2. Mr. Shekhar Badola, Advocate, for respondent No.3. By way of instant application, prayer has been made on behalf of applicant for release of compensation amount lying deposited with the Registry of this Court. Learned counsel representing the respondents No.1 & 2 and respondent No.3 fairly state that they do not wish to file reply to the application and shall have no objection in case amount, sought to be released, is released in favour of the applicant. 2. Careful perusal of averments contained in the application, which is duly supported by way of affidavit, reveals that this Court vide judgment dated 10.07.2018, passed in FAO(MVA) No.76 of 2018, allowed the appeal preferred by the applicant herein, as a result thereof, award passed by learned MACT in MAC Petition No.96- S/2 of 2014/11 came to be modified. 3. Earlier, MACT, Shimla, had awarded compensation to the tune of Rs.2,62,000/- in favour of the applicant, but this Court while passing judgment, detailed hereinabove, enhanced the amount to Rs.4,30,000/- from Rs.2,62,000/-. Since no appeal ever came to be filed against the aforesaid judgment passed by this Court, same has attained finality. Enhanced amount of compensation has been already deposited with the Registry of this Court. 4. In view of the above, this Court sees no impediment in accepting the prayer made in the application and accordingly, the same is allowed. Award amount, in terms of judgment dated 10.07.2018 passed by this Court in FAO(MVA) No.76 of 2018, is ordered to be released in favour of the applicant along with up-to-date interest, by remitting the same in his Bank Account, as detailed in Para 7 of the application, subject to verification.
