Heard learned counsel appearing on behalf of the parties. 2. In the present writ petition following substantial prayers have been made by the petitioners:- "(a)- issue a writ, order, or direction in the nature of certiorari quashing the impugned order dated 12-11-2024 passed by respondent No. 3, whereby mutation of the names of respondents no. 4 to 6 for Tax Collection of the House No. 2/A, Mohalla Badi Kamhariya, Pardaha, Tehsil-Sadar. Mau has been made in the records of the Nagar Palika Parishad, Maunath Bhanjan, Mau by excluding the name of the petitioners (Annexure No. 1 to the writ petition). (b) to issue a writ, order, or direction in the nature of writ of mandamus commanding and directing the respondent no. 3 to take half of the House Tax and Water Tax from the petitioners by including the name of petitioners in the records of the Nagar Palika Parishad, Maunath Bhanjan, Mau in respect of the House No. 2/A, Mohalla Badi Kamhariya, Pardaha, Tehsil-Sadar, Mau." 3. Upon perusal of documents and upon hearing the learned counsel appearing on behalf of the parties, we are of the view that since alternative remedy is present under the statutes, this is not a fit case to interfere. 4. Accordingly, this writ petition is disposed of with a direction upon the petitioners to file an appeal before the appellate authority. In the event the appeal is filed the appellate authority is directed to pass a reasoned order on the same, after granting an opportunity of hearing to the petitioners, within a period of eight weeks from the date of filing of the appeal.
