Neutral Citation No. - 2025:AHC:132611 Court No. - 52 Case :- WRIT - A No. - 11120 of 2025 Petitioner :- Jageshwar And Another Respondent :- State Of Uttar Pradesh And 4 Others Counsel for Petitioner :- Anurag Shukla Counsel for Respondent :- C.S.C.,Rishu Mishra Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Anurag Shukla, learned counsel for the petitioners, learned Standing Counsel for the State respondent nos. 1 & 2, and Ms. Rishu Mishra, learned counsel appearing for respondent nos. 3 to 5. The petitioners have preferred instant writ petition for a direction upon respondent no. 4 - District Basic Education Officer, Hamirpur to grant benefit of annual increment, which fell due in July, 2015, in regular pension being received by them w.e.f. 01.04.2016 and release of arrears of pension accordingly. Learned counsel for the petitioners submits that for ventilation of grievances, the petitioners have approached the authority concerned by moving representations. However, despite several representations moved by the petitioners, no heed has yet been paid. Learned counsel for the State-respondents submits that in case petitioners move fresh application/representation before the competent authority, the same shall be considered and decided in accordance with law. Considering the facts and circumstances of the case but without expressing any opinion on the merits of the case set up on behalf of the petitioners, the present writ petition is disposed of by providing that the petitioners may make fresh applications/representations, separately, ventilating all their grievances, supported by all relevant documents, as may be advised, before the respondent no.4 within two weeks from today along with a certified copy of this order. On such representation being made, respondent no.4 shall make all endeavours to consider and decide the same, strictly in accordance with law, by means of a reasoned and speaking order, after giving proper opportunity of hearing to the parties concerned, as expeditiously as possible, preferably within a period of four weeks from the date of production of certified copy of this order, if there is no legal impediment.
