HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 28694 of 2025 Court No. - 40 HON'BLE SARAL SRIVASTAVA, J. HON'BLE AMITABH KUMAR RAI, J. 1. Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents. 2. The grievance of the petitioners is that the petitioners are farmers engaged in cultivation of sugarcane and their only source of livelihood is the income generated from sugarcane farming. The petitioners have been growing sugarcane for the last 30 years and have been supplying their entire produce to the respondent No. 5 – Kisan Sahkari Chini Mills Ltd., Hasanpur, District Amroha. On account of old age and lack of proper transportation facilities in the area, the petitioners are unable to deliver the sugarcane at the aforesaid sugar mill. For this reason, the petitioners sought permission to supply their sugarcane at the Purchase Centre, Dehar, District Amroha. It is submitted that respondent No. 4 has arbitrarily declined to permit the petitioners to supply their sugarcane at the Dehar Centre, whereas other farmers have been allowed to do so. Due to the arbitrary action of respondent No. 4, the petitioners suffered heavy losses in the crushing season 2024-25 as they could not supply their sugarcane to the mill. In this regard, a representation dated 17.8.2024 was submitted by the petitioners before respondent No. 4, but no decision has been taken thereon till date. 3. Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to the respondent no. 2 to consider the grievance of the petitioners. Versus Counsel for Petitioner(s) : Safal Pandey Counsel for Respondent(s) : C.S.C. Surendra Kumar And 2 Others .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) 4.
