(Oral) Applicant Pradeep Singh Rana is in judicial custody in FIR/Case Crime No. 79 of 2023 dated 23.09.2023, under Sections 323, 325, 504, 506, 307 & 120-B IPC, Police Station Jhankaiya, District Udham Singh Nagar. He has sought his release on bail. 2. This is third bail application of the applicant. His first bail application and second bail application were rejected on 24.10.2024 and 08.04.2025 respectively. 3. Heard learned counsel for the parties and perused the record. 4. Learned counsel for the applicant would submit that after rejection of the first bail application, the applicant was detected HIV positive; he is unwell; his condition is deteriorating. 5. Learned State Counsel admits that the applicant is an HIV positive. But, he also submits that the applicant is under antiretroviral therapy (ART). 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 2 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
