Case No.07 of 2024, Corresponding to Spl. POCSO Case No. 33/2024 registered under Sections 376(3) of the Indian Penal Code and Sections 4/6 of the POCSO Act, pending in the court of learned Special Judge, Exclusive (POCSO), Court, Jamshedpur. Bail application of the petitioner was earlier rejected by co- ordinate bench of this court vide B.A. No. 4264 of 2024 by order dated 14.08.2024. On 23.02.2024, at about 09:00 P.M., the petitioner on the pretext of dropping the prosecutrix home, took her to a nearby forest and raped her. Learned senior lawyer for the petitioner submitted that the statement of the victim has been recorded during the trial and the petitioner is in custody since 02.03.2024. Regard being had to the facts and circumstance of the case and considering the nature of allegation; I am not inclined to enlarge the petitioner on bail.
