1. Mr. Vinod Sharma and Mr. Kamlesh Budhlakoti, learned counsel for the applicant.

3. The present applicant ‘Sunil Rana’ is praying for regular bail in relation to First Information Report dated 24.04.2025 bearing FIR No. 0037 of 2025 P.S. Muni Ki Reti District Tehri Garhwal, wherein, the present applicant has been implicated for the offence punishable under Section 8/20 of the NDPS Act.

It is submitted by the learned counsel for the applicant that the alleged contraband of charas which is shown to be recovered from the present applicant is 510 gms, which is below the commercial quantity, and furthermore there is one more criminal history of the present applicant in which he is already enlarged on bail.
5. Apart from this, he submits that there is no proper substantial compliance of Section 52A of the NDPS Act.

On the other side, Mrs. Pushpa Bhatt, learned Deputy Advocate General submits that the present applicant violated the terms and conditions of the bail granted by the Additional Sessions Judge, Kurukshetra, Haryanan, in similar nature of offence arising out of FIR No. 219 dated 25.07.2022 P.S. Ismailabad and as such the applicant does not deserve for bail.
7. After hearing the arguments of learned counsel for the parties and further taking into
consideration that the alleged contraband, which is shown to be recovered from the present applicant, is below a commercial quantity and furthermore in the Case Crime No. 219 of 2021 the applicant was already enlarged on bail, this court is of the view that the applicant deserve for bail but some stringent conditions should be imposed.
8. Accordingly, without expressing any

9. Let the applicant ‘Sunil Rana’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
10. It is made clear that after being released on bail the applicant shall report to the nearest police station in every 15 days and the concerned SHO shall record his presence, failing which the prosecution is directed to move an application for cancellation of bail.
