Heard the parties.
The petitioner has been made accused in connection with Sadar P.S. Case No. 68 of 2024 for the offences registered under sections 309(4)/ 312 of the Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Palamau at Daltonganj. On 11.07.2024, the Informant was waylaid by three persons near Pokhraha. The accused persons looted his mobile phone and other articles. Mr. Sheo Kumar Singh, learned counsel for the petitioner submitted that the petitioner is neither named in the FIR, nor he was put on T.I. Parade. It was further submitted that nothing incriminating has been recovered from the possession of the petitioner. Mr. Santosh Kumar Shukla, learned A.P.P. has opposed the prayer for bail and submitted that bail application of Yogendra Kumar from whose possession looted mobile phone has been recovered, has been rejected by this Court earlier. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Palamau at Daltonganj, in connection with Sadar P.S. Case No. 68 of 2024.
