The appeal is filed under Order 43 Rule 1 of CPC against the order passed on the application filed under Section 2 of the Partition Act, wherein the Trial Court accepted the report of the Court Commissioner. Therefore, the present appeal is dismissed as not - 4 - HC-KAR NC: 2025:KHC:31381 MFA No. 5264 of 2025 maintainable. However, liberty is given to the appellant to challenge the impugned order before the appropriate Court. 4. The appellant is entitled for the benefit of Section 14 of the Limitation Act. 5.
