Neutral Citation No. - 2025:AHC:87515 Reserved On:-16.05.2025 Delivered On:-23.05.2025 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 28580 of 2024 Applicant :- Mangal Singh Opposite Party :- State of U.P. Counsel for Applicant :- Akhilesh Kumar Vishwakarma,Anil Kumar Singh,Rajkumar Verma,Ranjeet Singh Counsel for Opposite Party :- G.A.,Jai Prakash Prasad,Rakesh Yadav Hon'ble Siddharth,J. Heard Sri Ranjeet Singh, learned counsel for the applicant; Sri Jai Prakash Prasad, learned counsel for the informant and learned A.G.A for the State. The instant bail application has been filed on behalf of the applicant, Mangal Singh, with a prayer to release him on bail in Case Crime No. 62 of 2024, under Sections 342, 376, 504, 506 of IPC, Police Station Chaubiya, District- Etawah, during pendency of trial. There are allegations against the applicant of committing the offence of gang rape against the victim and two unknown accused. The applicant after committing the alleged offence left his mobile phone at the place of victim and the victim called her mother from his phone and informed abut the incident.
Learned counsel for the applicant has submitted that it is a case of false implication of the applicant. The applicant and victim earlier entered into marriage. They lived as such for last one year before the incident, but thereafter, some dispute took place between them and the present F.I.R., was lodged. The victim has refused her internal medical examination before the doctor after the incident. The investigating officer has recorded the statement of the independent witnesses who have testified that the applicant and the victim lived as husband and wife for last one and a half years. The applicant has been falsely implicated in this case. He has no criminal history to his credit and is languishing in jail since
10.06.2024. The trial in the aforesaid case is not likely to be concluded in near future. Learned A.G.A., and learned counsel for informant have
vehemently opposed the prayer for bail of the applicant by contending that the innocence of the applicant cannot be adjudged at pre-trial stage, therefore, he does not deserves any indulgence. In case the applicant is released on bail, he will again indulge in similar activities and will misuse the liberty of bail. Having considered the submissions of the parties noted above, finding force in the submissions made by the learned counsel for the applicant, keeping in view the uncertainty regarding conclusion of trial; one sided investigation by police, ignoring the case of accused side; applicant being under-trial having fundamental right to speedy trial; larger mandate of the Article 21 of the Constitution of India, considering the paragraph no.53 of Apex Court in the case of Manish Sisodia Vs. Directorate of Enforcement
2024,
(SC)LawSuit 677 and considering 5-6 times overcrowding in jails over and above their capacity by under trials and without expressing any opinion on the merits of the case, let the applicant involved in the aforesaid crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :- (i) The applicant shall not tamper with the evidence or threaten the witnesses.
