Mr. Harshpal Sekhon, learned counsel for the applicant. 2. Mr. Siddhartha Bisht, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State. 3. The present applicant ‘Amana Begam’ W/o Shahbuddin is languishing in jail since 29.04.2025 in reference to First Information Report dated 26.03.2025 bearing FIR No. 0086 of 2025 P.S. Sitarganj, District Udham Singh Nagar, wherein, the present applicant his son Taufeek Ahmed, sister Nargis alias Gudiya and three other Babu, Rafeek and Akeel Ahmed were implicated for the offence punishable under sections 80(2) r/w 85 of BNS, 2023. 4. Learned counsel for the applicant submits that the applicant is the mother-in-law of the deceased, who commit suicide and the marriage of the applicant’s son with the victim took place four years back and there were no issues and this may be the reason that the deceased commit suicide. 5. He further argued that the applicant has no nexus with the allegations as alleged with regard to the demand of dowry and there was no such injury on the body of the deceased and per the counter affidavit the death is due to asphyxia as a result of ante mortem hanging. He submits that the chargesheet has already been filed and the other co-accused namely Nargis alias Parveen, the daughter of the present applicant, is already enlarged on bail by this court on 15.07.2025 in Bail Application No. 880 of 2025. 6. He further argued that since the chargesheet has already been filed and the deceased’s husband, who is the applicant’s son, is already in jail, therefore taking into consideration that the applicant is a senior citizen of 65 years old be released on bail. 7. On the other side, learned State counsel 2025:UHC:7110 have not disputed this fact that the chargesheet has already been filed and the other co-accused, the daughter of the present applicant Nargis @ Parveen was enlarged on bail by this court on 15.07.2025. 8. After hearing the arguments of learned counsel for the parties and taking into consideration that the chargesheet has already been filed and the husband of the deceased is already in jail and the other co-accused, who is the daughter of the applicant, is already enlarged on bail and the applicant is a senior citizen aged about 65 years, this court is of the view that the applicant deserves for bail. 9. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 10. Let the applicant ‘Amana Begam’ be released on bail on furnishing her personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
