His presence be marked. 2. The present revision arises out of the impugned order dated 27.12.2019 passed by Learned Judicial Magistrate First Class, Raipur (C.G.), whereby learned Magistrate has dismissed the complaint present by the applicant under Section 138 of the Negotiable Instruments Act for default in payment of process fee. 3. Learned counsel for the applicant submits that the order sheet itself shows that notices have been issued to the accused persons on 12.04.2016, 27.07.2017, 16.02.2018 & 19.02.2019, meaning thereby, the process fee was paid by the applicant several times. 5. On perusal of all the material available in the record, it is found that despite registration of a complaint under section 138 of N.I. Act, the presence of the accused could not be ensured, hence the complaint case has not been decided on the merits. On many occasions the processing fee was paid by the complainant, but on some occasions it was not paid. In such a situation, there is a need to interfere in the order 5 in question so that the complaint case can be decided on the merits of the case. The complaint case is of the year 2016, a delay has appeared. 6. Therefore, the impugned order of the trial court is set aside. It is directed that the complaint case shall be restored to its original status, subject to payment of the cost of Rs. 3,000/- to the District Legal Services Authority, Raipur. The complainant party is directed to be present on 25.08.2025 before the trial Court. The trial court is directed to decide the complaint case as per law, as expeditiously as possible. 7.
