By means of this writ petition, the petitioner has sought the following reliefs:- “i) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent no. 2 & 3 to submit the progress report before this Hon'ble Court in connection with first information report dated 26.04.2025 being FIR No.0049 of 2025 for the offences punishable under section 5, 6 of POCSO Act, 2012 and section 137(2), 351(2) and 70(2) of Bhartiya Nyaya Sanhita, 2023, Police Station Jhankaiya, District Udham Singh Nagar (annexure no. 1 to this writ petition) against respondent no. 4 to 7 by the petitioner within stipulated period as this Hon'ble Court may deem fit and proper under the governing facts and circumstances of the case. ii) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent authorities to conduct the fair and transparent investigation of first information report dated 26.10.2025 being FIR no. 0049 of 2025 for the offences punishable under section 5, 6 of POCSO Act, 2012 and section 137(2), 351(2) and 70(2) of Bhartiya Nyaya Sanhita, 2023, Police Station Jhankaiya, District Udham Singh Nagar (annexure no. 1 to this writ petition) as warranted under the law. iii) Issue a writ order or direction in the nature of mandamus commanding and directing the respondents to conclude the Investigation keeping in mind the provision contained under section 193 (1) and (2) of BNSS, 2023 by taking appropriate steps against the accused persons. iv) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent authorities to transfer the investigation of first information report dated 26.04.2025 being FIR no. 0049 of 2025 for the offences punishable under section 5, 6 of POCSO Act, 2012 and section 137(2), 351(2) and 70(2) of Bhartiya Nyaya Sanhita, 2023, Police Station Jhankaiya, District Udham Singh Nagar(annexure no. 1 to this writ 2 petition) to any other independent agency so that fair and impartial enquiry be carried out.” 4. Learned State counsel, on instructions, which are taken on record, submits that after investigation, a final report has been submitted in favour of the respondent – accused nos.4 to 7 and a notice has been issued under Section 217 of B.N.S. 2023 to respondent/informant. 5. Since the final report has been submitted after investigation, the informant has got remedy to challenge the said final report by filing a protest petition, in accordance with law. 6. In view of latest development, nothing remains to be decided in the present writ petition. 7. Accordingly, writ petition is closed. (Pankaj Purohit, J.) 26.06.2025 SK
