Counsel for the respective parties urged several contentions. Heard the arguments and perused the papers with care. 3. This application is C.A.No.15 of 2023 is filed to direct the Official Liquidator to execute the sale deed in respect of the property mentioned in the schedule. - 3 - HC-KAR NC: 2025:KHC:50779 CA No. 15 of 2023 In COP No.166 of 2001 4. The applicants contend that the company in liquidation had executed an agreement for sale in their favour. However, the company did not execute the sale deed in their favour because the company was ordered to be wound up on 01.04.2004. It is also contented that several purchasers of the site / quarters had filed application before this court seeking a direction to the Official Liquidator for execution of the sale deed after collecting balance sale consideration and obtained orders of this court. The applicants further contend that they are similarly situated persons, hence, they are seeking a direction to execute the sale deed. 5. I am unable to accept this contention. There is nothing on record to show that the company in liquidation had executed an agreement for sale in favour of the applicant. In the absence of any material documents to show that the company in liquidation had executed an agreement of sale in favour of the applicants, the prayer - 4 - HC-KAR NC: 2025:KHC:50779 CA No. 15 of 2023 In COP No.166 of 2001 seeking a direction to execute the sale deed cannot be accorded.
