ORAL ORDER
1. The detenu-Babu (CTP No.4191) is before this Court seeking for the following reliefs: i) Issue a Writ of certiorari and quash the impugned endorsement dated 30/06/2025 issued by the 2nd respondent bearing No. CPB/CTP-SEC/5950/2025 (produced vide ANNEXURE - 'D') to the writ petition; and
ii) Issue a Writ of certiorari and quash the impugned endorsement dated 29/06/2025 issued by the 2nd respondent bearing No. KEKABEM/J3/5903/2025 (produced vide ANNEXURE - 'G') to the writ petition; and
iii) Issue a Writ of mandamus directing the respondent No. 2 and 3 to release the petitioner on General parole for a period of 90 days by considering the Karnataka Prisons and Correctional Services manual 2021 (produced vide ANNEXURE - 'E') to the writ petition;

iv) Issue a Writ of mandamus directing the respondents No.4 & 5 consider the case of the petitioner having CTP No 4191 for premature release as per the direction issued by this Hon'ble court in W.P.No.29219/2024 as per the order dated 28/11/2024 (produced vide ANNEXURE - 'B') to the writ petition; and
v) Issue such other Writ, Order or Direction as deemed fit in the circumstances of the case, in the interest of justice & equity.
2. The detenu had been convicted in S.C.No.297/2008 for offences under Section 302 of IPC by the Prl. Sessions Judge, Bangalore Rural District and sentenced on 17.11.2011 with the highest of the sentence being imprisonment for life. The detenu has served a period of 13 years 03 months 25 days of imprisonment as on 27.06.2025 and his conduct in jail is said to be satisfactory. The detenu’s application for parole came to be rejected on account of pending proceedings in CC No.881/2019, in that background the detenu is before this Court.

Learned counsel for the petitioner submits that the said proceedings have been settled by way of compounding the matter and as such there are no

criminal proceedings which are pending as on date, in support thereof he had produced the downloaded
order sheet at Annexure-F.

Considering that the detenu had spent a period of 13 years 03 months 25 days of incarceration as on 27.06.2025 and had been released on general parole on five earlier occasions, emergency parole on one occasion and Court parole on one occasion for a total period of 1 year 3 months 13 days, I am of the considered opinion that there would be no complaint against the detenu during that time, parole could be once again granted to the detenu. In that view of the matter, I pass the following:
ORDER i. The Writ Petition is allowed. ii. Respondent No.2–Chief Superintendent, Central Prison, Bangalore, is directed to release the detenu- Babu (CTP No.4191) on parole for a period of 90 days commencing from 22.12.2025, subject to the following conditions:

A. The prisoner- CTP No.4191 shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of parole. B. Respondent No.1- State of Karnataka shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iii. The Registry is directed to communicate the
