The instant writ petition is preferred inter-alia with the following reliefs:- "(a). issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 to ensure the pay the amount of Rs.1964000/- in favour of petitioner forthwith. (b). issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 to take appropriate decision over the petitioner forthwith to consider the application dated 13.05.2025 within stipulated period as fixed by this Hon'ble Court." 3. After arguing at some length, learned counsel for the petitioner has confined his relief to the extent that the application dated 13.05.2025 may be processed in light of the judgement rendered by Hon'ble Supreme Court in M/s Surya Construction vs. State of Uttar Pradesh & Ors.; (2019) 16 SCC 794. 4. Learned counsel for the contesting-respondents is having no objection in case the grievance of the petitioner may be redressed in light of the judgement rendered by the Hon'ble Supreme Court in M/s Surya Construction (supra). 5. Considering the factual situation, without adverting on merit of the case, the writ petition is disposed of asking the respondent No.2 i.e. Superintending Engineer Nagari Vidyut Mandal-I Bhelupur, District- Varanasi to take a final call to decide the application dated 13.05.2025 filed by the petitioner, precisely taking note to the judgment rendered by Hon'ble Supreme Court in M/s Surya Construction (supra) within a period of three months, from the date of production of certified copy of this order.
