The petitioner is before this Court seeking the following prayers:
“A) Issue Writ of certiorari or any other writ or
order quashing the impugned endorsement dated 30-01-2024, kra. Sam: VA. KA. RA. SA/DHA.GRAVI/Karmika/1647, vide Annexure-E, issued by the 1st Respondent, B) Consequent upon quashing the endorsement aforesaid, issue writ of mandamus directing the respondents to reimburse the medicla bills of Rs.4,92,922/- as stated in the application at Annexure-C, by fixing outer limit, and C) Issue any other writ or order as this Hon’ble court may deems fit in the Circumstances of the case including the cost in the interest of justice.”

2. Heard Sri Ravi Hedge, learned counsel for petitioner and Sri Prashant Hosamani, learned counsel for respondents.

Facts in brief germane are as follows : The petitioner is appointed as a driver-cum- conductor in the respondent-Corporation in the year
2007. He is said to be a permanent employee. The petitioner owing to certain heart ailment undergoes surgery in a hospital which was recognized or in the list of hospitals in the Corporation. The said hospital is said to have referred the petitioner for different hospital for higher treatment. The petitioner then gets himself treated and the hospital would raise a bill of Rs.4,92,922/-. The petitioner owing to his entitlement for reimbursement of the bills, in terms of the policy of the Corporation, submits a representation enclosing certain bills. The reimbursement is rejected on the score that the bills do not contain the signature or adequate information about the surgery undertaken by

the petitioner. It is therefore the petitioner is before this Court in the subject petition.

Learned counsel appearing for the petitioner submits that the petitioner would submit an appropriate representation with appropriate bills as necessary in terms of the scheme, which would be with the sign and seal of the concerned doctor of the hospital and complete details of the treatment taken by the petitioner.
5. The counsel appearing for the respondents would submit that if entire material in terms of the scheme/policies the Corporation is submitted, the Corporation would be in a position to assess and consider the medical claim for medical reimbursement to the petitioner.
6. In that light, I deem it appropriate to dispose the petition directing the petitioner to submit another representation enclosing all details as

observed hereinabove to the Corporation and in the event the said information is adequate, the Corporation shall consider the same and pass necessary orders in accordance with law. Compliance shall be made within four months from the date of receipt of copy of the
order.
