The petitioner has been made accused in connection with S.T. Case No.92 of 2024, corresponding to G.R. No.38 of 2024 arising out of Chainpur P.S. Case No. 42 of 2023, for the offences registered under Sections 302, 307, 326 and 342 of the I.P.C., pending in the Court of learned Additional Sessions Judge-II, Gumla. On 23.10.2023, the petitioner is alleged to have given a hoe blow to his father-in-law, due to which he succumbed to his injuries. It was submitted that the occurrence has taken place due to sudden provocation because the deceased was not allowing the wife of the petitioner to accompany him. It was finally submitted that no case under Section 302 of the I.P.C. will be made out, but in fact it will be a case under Section 304 of the I.P.C. In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Gumla, in connection with S.T. Case No.92 of 2024, corresponding to G.R. No.38 of 2024 arising out of Chainpur P.S. Case No. 42 of 2023. (Ambuj Nath, J.) Jay/-
