Heard learned counsel for the revisionist, Sri Rajneesh Tripathi, Advocate holding brief of Sri Tarun Pratap Singh, learned counsel for the opposite party no. 2 and the learned A.G.A. for the State. Perused the record. 2. Learned counsel for the revisionist has submitted that the impugned order has wrongly been passed by the trial court. 3. The application under Section 311 Cr.P.C. was rejected by the learned trial court. The trial is of offences under Sections 302, 307, 147, 148, 323, 504, 506, 120-B, 34 IPC and Section 30 of Arms Act, which are grievous and henious sections. The learned trial court has himself admitted in page 2 of the impugned order dated 21.5.2025 and raised some doubt about completion of the cross-examination by the revisionist/accused Saurabh Yadav @ Pintu. The prosecution has to produce the correct facts and all opportunity of hearing for the completion of trial and the completion of fair trial proceeding is one of the fundamental right of accused. 4. In view thereof, the opportunity of cross-examination is provided to the accused/Saurabh Yadav @ Pintu with the condition that he has to complete his cross-examination with P.W-1 Bhupendra on the same date when he would appear before the trial court for the same. The revisionist is hereby also directed that he shall pay a cost of Rs. 10,000/- to P.W-1 Bhupendra at the time of his appearance for the cross-examination before the trial court.
