JUSTICE SANDEEP KUMAR ORAL ORDER 5 18-04-2025 Heard the learned counsel for the petitioners and learned APP for the State. 2. This is the 2nd Attempt on behalf of the petitioners. The petitioners seek regular bail in connection with Mansi P.S. Case No. 20 of 2023 registered for the offence under Section 394 of the Indian Penal Code. 3. As per the prosecution case, the petitioners are the accused of looting a motorcycle, mobile phone and cash from the victim. 4. Learned counsel for the petitioners submits that petitioners are innocent and have not committed any offence. petitioners are in custody since 03.09.2023. Petitioners have not Patna High Court CR. MISC. No.80594 of 2024(5) dt.18-04-2025 2/2 been identified in T.I. parade. 5. Learned A.P.P. has vehemently opposed the prayer for bail. 6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed. 7. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Khagaria/concerned Court below in connection with Mansi P.S. Case No. 20 of 2023 subject to condition that:- (i). The petitioners will mark their attendance at the Bhakhtiyarpur Police Station, Saharsa on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioners. (ii) The petitioners shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioners.
