ORAL ORDER
1. The petitioner filed this writ petition seeking for a mandamus directing the respondents to consider the representation dated 06.02.2023, wherein, the petitioner requested the respondents to appoint the petitioner who is the next eligible candidate under GM-Rural category/quota to the post of Assistant with all consequential benefits.

Brief facts leading rise to the filing of this petition are as follows:
3. The respondents published the employment notification for various posts including that of total 70 posts of Assistant in CESC on 08.09.2016. The petitioner submitted online application for the post of Assistant on 16.09.2016. The respondents published 1:2 select list in which the name of the petitioner was published at serial No.33, on 13.11.2017. The

petitioner's documents were verified by the respondents. However, in the final selection list, the name of the petitioner was not published. Further, the respondents rejected the candidature of one R. Chandan, who was selected for the post under GM- Rural Quota, due to non-furnishing of Rural Certificate and non-creamy layer certificate. The said R.Chandan approached this court in WP No.25155 of
2018. The writ petition filed by R.Chandan came to be dismissed and liberty was reserved to the petitioner herein to file a fresh writ petition seeking appropriate relief. The petitioner submitted a representation on 06.02.2023 to the respondents. The respondents did not consider the said representation. Hence, this writ petition.

Learned counsel appearing for the respondents submits that if reasonable time is granted, the respondents would consider the representation dated

06.02.2023, and pass the appropriate order in accordance with law.

Learned counsel for the petitioner filed a memo along with representation dated 06.02.2023 and the same is taken on record. Further, the petitioner is directed to furnish the copy of the representation dated 06.02.2023 to the
learned counsel for the respondents.
6. In view of the submission made by the learned counsel for the respondents, I proceed to pass the following order:
ORDER i. The writ petition is allowed in part. ii. The respondents are
directed to consider the representation dated 06.02.2023, and pass the appropriate
order in accordance with law within 8

weeks from the date of receipt of the copy of this order. iii. In view of disposal of the petition, pending interlocutory applications, if any, do not survive for consideration and they are disposed of accordingly.
