Heard Sri Pramod Kumar Sinha, learned counsel for the petitioner and learned Standing Counsel for the State respondents. The grounds raised are that petitioner was already working in an aspirational district since 2016 and, therefore, he should not have been transferred to another aspirational district, especially when he had given option as required under Clause 4(iv) of the transfer policy dated 6th May, 2025. It is contended by learned counsel for the petitioner that petitioner had given option online as well as by sending hard copy application physically on 17th June, 2025 much prior to the passing of the transfer order but the same was ignored and petitioner has been transferred to another aspirational district Jhansi under the transfer order. Per contra, learned Standing Counsel submits that there are some inquiry pending against the petitioner and that is why he has not been posted in any of the districts opted by the petitioner. In the given facts and circumstances of the case, I consider it appropriate for the petitioner to make a fresh representation in the light of the transfer policy dated 6th May, 2025 within a period of two weeks from today before the competent authority, namely respondent No.- 2, who shall be passing the order within a further of four weeks. Considering the facts and circumstances of the case that petitioner has again been transferred from one aspirational district to another aspirational district, it is hereby provided that until such decision is taken by the authority or for the period of six weeks from today, no coercive action shall be taken against the petitioner pursuant to the order dated 25th July, 2025. With the aforesaid observations and directions, this petition stands disposed of.
